• Offer refers to the availability of specific equipment linked to a Product Listing, including details such as year, condition, price (excluding VAT), and other descriptive elements. Offers are published under the sole responsibility of the Seller.
• Platform / Website refers to the website accessible at https://medigear.uk.
• Products / Equipment refer to medical or healthcare equipment listed on the Platform. Unless otherwise specified, products may include both new and pre-owned equipment.
• Services refer to additional services offered by Medigear Group Limited, including but not limited to transport, warranty, and financing.
• Seller(s) refer to healthcare professionals or authorised representatives of organisations offering equipment for sale via a registered User Account.
• Buyer(s) refer to healthcare professionals or authorised representatives purchasing or reserving equipment through a User Account.
• User refers to any individual accessing or browsing the Platform.
• Catalogue refers to all Product Listings and Offers available on the Platform.
• Organisation refers to a registered legal entity (company, partnership, or sole trader) linked to one or more Users for business activities on the Platform.
• User Account refers to the personal account enabling access to Platform features, including profile data, order history, and account management tools.
• Categories refer to the classification of Products (e.g., diagnostic equipment, surgical instruments, monitoring systems).
• Specialities refer to clinical or medical fields associated with Products (e.g., cardiology, dermatology).
• Brand refers to the manufacturer of the Product.
• Any reference to time (days or hours) refers to UK business working days/hours unless otherwise stated.

II. CREATION OF USER ACCOUNT

Access to the Platform is available without registration; however, purchasing, selling, or reserving equipment requires a User Account.

To create an account, Users must provide:

• Full name
• Organisation or business name (if applicable)
• Contact details (email and telephone)
• Secure password

Each email address may be used to create only one account.

Users must:

• Provide accurate and complete information
• Keep login credentials confidential
• Notify Medigear immediately of any suspected unauthorised access

By creating an account, Users agree to these Terms of Use, which may be updated periodically and remain accessible on medigear.uk.

Account Suspension or Termination

Medigear Group Limited reserves the right to suspend or terminate accounts in cases including:

• Repeated inaccurate or misleading equipment listings
• Failure to meet product condition or compliance standards
• Failure to fulfil orders or respond to claims
• Payment default by Buyers

Any ongoing transaction at the time of suspension will be processed to completion.

Users may request account deletion at any time by contacting Medigear Group Limited at the registered office address.

III. INTELLECTUAL PROPERTY

All content on medigear.UK, including:

• Product Listings
• Text, graphics, and design
• Databases and platform technology

is protected under UK intellectual property laws.

The following are strictly prohibited:

• Copying, reproducing, or modifying any content
• Using automated systems (including bots or scraping tools) to extract data

IV. CATALOGUE AND SEARCH

The Platform catalogue includes all available Products and Offers.

Users may:

• Search by product type, brand, or model
• Apply filters such as price, condition, speciality, and category
• Modify or remove filters at any time

Medigear Group Limited does not prioritise or promote specific listings unless explicitly stated.

V. SHOPPING CART AND RESERVATIONS

Users may select available Offers and:

• Reserve equipment for up to 48 hours (subject to applicable fees)
• Receive notifications when out-of-stock items become available

Users must provide:

• Delivery address
• Billing details
• VAT information (if applicable)

Additional services (e.g., express delivery, warranty, financing) may be requested during checkout.

All purchases are governed by the Terms of Sale.

VI. PAYMENT TERMS

Payments must be made via:

• Bank transfer to Medigear Group Limited

Full payment must be received prior to dispatch (unless financing is arranged).

Medigear will issue:

• Equipment invoice
• Service invoice (if applicable)

All transactions are secured in accordance with recognised European banking and payment security standards.

VII. SELLING EQUIPMENT

Approved Sellers may list equipment via their User Account in compliance with applicable standards.

Sellers are responsible for:

• Accuracy of listings
• Regulatory compliance of equipment
• Availability and condition of products

Delivery commitments:

• Express: within 48 working hours
• Standard: within 3 weeks

Medigear Group Limited does not edit Seller listings and is not responsible for Seller content.

VIII. ROLE OF MEDIGEAR GROUP LIMITED

Medigear Group Limited operates as a marketplace intermediary, providing:

• Secure payment processing
• Logistics coordination
• Optional services (financing, warranty, transport)

Medigear:

• Is not the owner, seller, or distributor of listed equipment
• Does not take possession of Products
• Is not a party to contracts between Buyers and Sellers

As a hosting provider under the Electronic Commerce Regulations 2002, Medigear is not liable for Seller-generated content but reserves the right to remove unlawful material.

IX. PLATFORM AVAILABILITY

Medigear Group Limited may temporarily suspend access to the Platform for maintenance or updates without prior notice.

X. APPLICABLE LAW AND DISPUTE RESOLUTION

These Terms of Use are governed by the laws of England and Wales.

In the event of a dispute, Users are encouraged to seek an amicable resolution by contacting Medigear Group Limited.

If no resolution is reached, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
